Thank you for choosing HeyTutor, Inc. (“HeyTutor,” “we,” “us,” or “our”). We value the privacy of our users, and we are committed to protecting your privacy and the privacy of your students. This Privacy Policy describes the information we collect from users, as well as how and when we disclose or use it. By visiting the website located at wp.heytutor.com (“Site”) or using the products, platforms, services, applications, and/or content offered by HeyTutor (“Services”), you are consenting to the collection, use and disclosure of your personal information or the personal information of your students as set forth in this Privacy Policy.

 

For clarity, this Privacy Policy does not apply to our employees, job applicants, and independent contractors.

 

Information Collected by HeyTutor

We collect and process both non-personal and personal identifying information from students and Educational Institutions to provide our tutoring services effectively. This may include:

  • Information submitted by school district or school site administrators about themselves, such as first and last name, email address, username and password, country of residence, school district or school site name, and zip code.
  • Information submitted by a school district about students within that district, such as first and last names, contact information (email), usernames, grade level and performance data.
  • Information and content submitted by students, such as responses to questions in lessons and assessments.
  • Information about the use of HeyTutor’s Services, including a user’s general location (based on IP address or GPS), when, and for how long a user accesses HeyTutor’s Services.
  • Video and audio recordings of tutoring sessions if permitted by the school or district.
  • Information from and about a user’s device, such as device type, browser type and version, operating system name and version, IP address, and referring URL. We collect this information automatically when you access HeyTutor’s Services, to help us diagnose problems and provide support.

 

We do not use cookies, pixel tags, or other technologies to track your use of third-party services.

 

Use of Information Collected

We use and disclose the collected information for various purposes, including but not limited to:

  • Providing tutoring services and educational support to students.
  • Coordinating tutoring services with school districts and school sites (“Educational Institution”).
  • Enabling administrators to monitor student performance and progress.
  • Managing and maintaining student performance records using HeyTutor’s Services.
  • Communicating with students during a virtual tutoring session.
  • Communicating with Educational Institutions regarding students’ performance.
  • Processing payments and billing for HeyTutor’s Services.
  • Diagnosing problems, troubleshooting issues, and conducting maintenance.
  • Improving our services, website, and platforms.
  • Complying with legal and regulatory obligations.
  • To our third-party service providers, who assist with website hosting and customer service, to permit them to provide those services to us.
  • To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in bankruptcy or similar proceedings).
  • As necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce our terms and conditions; (v) to protect our operations or those of any of our affiliates; (vi) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (vii) to allow us to pursue available remedies or limit the damages that we may sustain.
  • HeyTutor reserves the right to use and disclose information that does not identify or otherwise directly relate to an individual for any purpose, subject to any restrictions imposed by applicable law.

 

User Access to Personal Identifying Information

Under certain privacy laws and regulations, students and their parents or guardians may be permitted to view, edit, or delete their own personal information that is collected and retained by HeyTutor. For instance, under the California Consumer Privacy Act and California Privacy Rights Act Rights, you have certain rights regarding your personal information:

  • Access: You can request information about the personal information we have collected about you.
  • Deletion: You can request the deletion of your personal information, subject to certain exceptions.
  • Opt-Out: You can opt out of the sale of your personal information. Please note that HeyTutor does not sell personal information of students or Educational Institutions’ administrators and staff.
  • Non-Discrimination: We will not discriminate against you for exercising your rights.

 

If you have questions about such access, please contact the Educational Institution through whom you or your student are using HeyTutor’s Services. The Educational Institution will forward such access requests to HeyTutor.

 

Data Security

HeyTutor is committed to complying with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), the Family Educational Rights and Privacy Act of 1975 (“FERPA”), and the Protection of Pupil Rights Amendment (“PPRA”) (collectively, “Privacy Laws”) in conjunction with HeyTutor’s Services for Educational Institutions. With regard to school-based activities, the Privacy Laws permit teachers and school administrators to provide consent for the collection of information from students. Any Educational Institution working with HeyTutor should always notify parents about these activities and obtain the necessary consents. Consistent with the Privacy Laws, HeyTutor shall be considered a school official with a legitimate educational interest in student information. Our Site does not collect or retain any personal information from children except as needed to facilitate tutoring for that student, who may be a minor. By contracting with HeyTutor, each Educational Institution represents and warrants that it has obtained and provided all necessary consents and notices that are required under Privacy Laws in order to allow the sharing of student information with HeyTutor.

 

In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, student information and/or student data (a “Security Incident”), HeyTutor shall notify the Educational Institution without undue delay upon learning of such Security Incident. Except to the extent that the Security Incident arises from the acts or omissions of the Educational Institution, HeyTutor will provide reasonable assistance and cooperation to the Educational Institution as may be required under Privacy Laws to investigate and remediate a Security Incident.

 

HeyTutor will retain collected information for the period of time needed to provide tutoring services to the Educational Institution and its students and/or for the period of time specified in an agreement with the Educational Institution.

 

Updates to this Policy

We may update this Privacy Policy from time to time. Any changes will be effective when the revised policy is posted on our website. We encourage you to review this policy periodically. Your use of the Services following any update to the Privacy Policy means that you accept the revised terms.
